a) Remember that your human resource person works for the company not the employees. Get everything in writing and save every email at home. I had mine at work and it was all shredded before I was able to pick up my things!
b) The LM representative’s job is to deny coverage by any means possible! Never say you are fine or OK, use the phrase ‘as well as can be expected’ everything you say will be used against you!
c) Request the entire LTD policy! Most policies have:
i. Have only 1 appeal and then no new evidence can be introduced after that
ii. SSDI is subtracted out of your benefit payments
iii. You are not able to collect punitive damages
iv. There are a ton of loop holes and the wording is confusing
d) LM will pay benefits for about 2 months and then start suspending payments. Most common reason is the doctors’ are not sending notes, even thought some were faxed in 4 times in my case.
i. This allows the company to show corporations that they pay benefits so they can sell more policies!
e) If denied benefits payments request the entire administrative file, before you file your appeal. This will prevent the surprises I had (more on this later).
f) If denied benefits payments get a lawyer ASAP
i. Good luck if you make less that $50,000 a year. This is because LM does not settle cases; they force the civil suit to be filed 12a686d

I am completely disabled and each month they want doctors reports, which they have and say they do not. They have suspended my LTD saying that my doctor never sent in the paperwork, I have myself faxed it in.. they have it they just do not want to pay. Looks like I am off to court at any const. I would rather receive nothing and pay it all to an attorney then let LM get away with this! |

Written by Looking for answers on March 21, 2012 from -, -, US It also seems that even though you have debilitating symptoms & multiple visits to the doctors, specialists & hospitals that Liberty Mutual will shut the door so fast. Who would pay all these co pays, spent at least $1000 or more to go to the emergency room several times a month to only get 60% of their pay, and the patient is in their mid 20's? It can take months if not years and several doctors to find out what is wrong with someone in some cases. I'm fed up. I've read that they if there is any depression/anxiety the company will be put up front in their cases while the medical information gets put in the back burner. Who wouldn't be depressed or anxious when doctors can't figure out what is wrong with you? Shame on our employer for using this crooked company!! |

I would love to hear about what your attorney is looking into in terms of class action...Unfortunately, I think that Liberty will cntinue to get away with their unethical ways due to ERISA...I was basically told that because they had a smidge of info that may support their decision, a judge could not decide against them...In essence, 99% of the info could be in total support of my disability and 1% against, and that 1% allows them to be ruthless animals and deny benefits. I worked for this company for 10 years before my claim in STD and Isaw first hand how LTD was handled...there were goals for closing or denying LTD claims every month, and they would celebrate the death of a claimant as it meant the claim could be closed. Please, if you still check here, let me know more about your lawyer, those you know in our situation, etc. I am trying to let this go, but am beyond angry. |

Please respond back to my post here - maybe there is a way we can touch base. I was approved for STD, then LTD for 3 mos until they found a different doctor to refute the evidence. Social Secuirty approved me on 1st try as I have a verified and qualifying disabling disease - it was very easy for judge to make decision. Liberty Mutual's abuse oushed me to obtain an attorney to file appeal & then the Lawsuit after appeal denied. I'm going to push this as far as possible just on principal. Since I've been in contact with several others who sound just like us, my attorney would be interested in looking into some type of class action suit. This will be difficult sinnce they have ERISA protection but it is possible. I wish you the best. If possible, pleae respond to help in the fight. |

Written by Screwed by Liberty LTD & ERISA on September 3, 2011 from somersworth, new hampshire, US Can't say much as a lawsuit is pending, but I have a chronic pain disorder that prevents me from standing, sitting or walking for very long without having excruciating pain. I have undergone 2 failed surgeries, and there are no further treatment options. I treat only with pain management (and a psychiatrist for the depression & anxiety related to no longer being the provider for my family). Pain management prescribes multiple meds including close to 300 mgs of Morphine a day, in addition to Tramadol for pain, xanaflex for muscular spasms,and Ritalin to help me remain conscious on all of these! I worked for as long as possible with this condition, however the pain became too much to bear & the meds were causing me to fall asleep or make errors on the job. My STD claim was approved, with Liberty's nurse noting this was a permanent condition unless I had another surgery (which I won't be). Then, LTD took over who immediately said I was faking (despite a multitude of medical records & test results) and that I was nothing but a drug seeker. They sent me to an "independent" dr who claims to have examined me, though he really did very little. He said I exagerated my response to my pain and that I could work at a medium job 40 hours a week, so I was denied. Social Security disability has approved me, however. So, it has come to the lawsuit, which I will most likely lose due to this ERISA law which allows the company to basically do whatever they want. I have told everyone I know, don't pay for group LTD coverage if it is an ERISA plan...it will never be there for you. If I had known, I would have gotten my own individual policy. And I warn everyone about having any coverage with Liberty - DON'T DO IT!! They are the most unethical company I have ever seen, giving awards to the employees who close or deny the most claims, thereby saving the most money. It just makes me sick. God Bless Social Security for seeing the truth...I was approved 1st go-round, never even needing to appeal!!! Liberty is truly evil. |
